These Terms of Use (hereinafter referred to as "these Terms") are entered into between you and Mactukd.com (hereinafter referred to as "Mactukd," "we," "us," or "our") and govern your access to and use of our website and related services. These Terms apply to, but are not limited to, Mactukd's official website, mobile services, email services, applications, and other products and services provided by us (collectively, the "Services").

By accessing or using any Mactukd Service, you acknowledge that you have read, understood, and agree to be bound by these Terms.

Your use is also subject to Mactukd's Privacy Policy and other applicable policies and regulations (if any), which are separately published. These policies are incorporated into and have the same legal effect as these Terms.

If a Mactukd Service has separate terms of use, privacy statements, or other supplemental policies (collectively, "Separate Terms"), those Separate Terms, as amended from time to time, will govern your use of that Service. In the event of a conflict between the Separate Terms and these Terms, the Separate Terms will prevail.

If you do not agree to these Terms or the relevant policies, please do not access or use any Mactukd Service.

Changes to Terms

Mactukd reserves the right, at any time and in its sole discretion, to modify these Terms or impose new terms and conditions for the use of and access to Mactukd Services. Any such modifications or additions will be effective immediately upon notice, or at such time as otherwise specified in the notice. This notice may include, but is not limited to, posting the revised or additional terms and conditions on the Mactukd Service page or notifying you through other reasonable means.

You are responsible for regularly reviewing these Terms to ensure you are aware of any changes that may affect your rights and obligations. Your continued use or access of Mactukd Services after receiving notice of any revisions or additions will constitute your acknowledgement of and acceptance of the changes and your agreement to the changes.

No changes to these Terms will be effective or binding unless in writing and signed by a duly authorized representative of Mactukd.

Termination of Service

These Terms will remain in effect until terminated by Mactukd. Mactukd reserves the right to terminate the provision of any Mactukd Service or these Terms in their entirety at any time without prior notice. Upon termination, you will no longer be authorized to access the Services, but the provisions regarding content ownership, disclaimers, indemnification, limitation of liability, and dispute resolution (including arbitration agreement, class action waiver, and jury trial waiver) will continue to apply to you.

In addition, Mactukd reserves the right to terminate all or part of the Services and their features, or any individual user's access to and use of the Services, at any time, without prior notice or liability.

Prices, Orders, Shipping and Handling

All prices displayed on the Mactukd Services are in U.S. dollars (USD). All orders may incur shipping, handling, and applicable sales or use taxes.

Mactukd reserves the right to adjust the prices, specifications, and availability of products or services at any time without prior notice. Any reference to goods or services should not be construed as a guarantee or endorsement by Mactukd. Inventory is limited and available while supplies last.

Your receipt of an order confirmation (whether from Mactukd or a third-party payment provider) indicates only that we have received your order request and does not constitute formal acceptance of your order. We may verify and review order information before accepting it. Even after an order has been confirmed, Mactukd reserves the right to refuse or cancel all or part of an order for any reason, including but not limited to product quantity restrictions, payment issues, or potential fraud.

We have made every effort to accurately represent product colors, but the colors you see on your device may vary depending on your display settings.

If a product or service is incorrectly priced due to a partner error or typographical error, Mactukd reserves the right to cancel or refuse orders (including confirmed or charged orders) at the incorrect price. If payment has already been made, Mactukd will promptly refund the difference to the original payment account.

Title and risk of loss for the product pass to you upon delivery of the product to the carrier. Shipping and handling charges may include, but are not limited to, labor costs, packaging supplies, back-office processing costs, and logistics carrier fees. Some states may impose sales tax on shipping and handling charges.

Return and Exchange Policy

We want you to be satisfied with every purchase you make through Mactukd. If you are dissatisfied for any reason, you may return or exchange your product within 30 days of receipt.

Coupons and Promotional Codes

All coupons and promotional codes provided by Mactukd are for personal use only and may not be transferred, resold, publicly distributed, or otherwise shared, unless expressly authorized in the relevant promotional terms.

If Mactukd has reason to suspect that a coupon code has been abused, misused, or used fraudulently, or by an unauthorized individual, Mactukd reserves the right to cancel the order and pursue legal action.

Legal Compliance and Compliant Use

You agree to comply with all applicable laws and regulations governing your use of Mactukd services, including but not limited to those relating to e-commerce, consumer protection, intellectual property, and export control. You are solely responsible for all actions and transactions under your account. We are committed to fostering a positive, honest, and safe shopping and interaction environment and reserve the right to restrict or prohibit harmful activity.

User Eligibility

You must be 18 years of age or older to register and use Mactukd services. If you are under 18, you must obtain authorization from your parent or legal guardian to use the Services and have them agree to these Terms on your behalf.

Content

All text, images, graphics, trademarks, brand logos, icons, software, and multimedia materials (collectively, the "Content") contained in the Mactukd Services, including the compilation and arrangement of the Content, are protected by copyright, trademark, and other intellectual property rights under United Kingdom and international laws.

Unless otherwise expressly stated, you may use the Content solely for your own personal use, such as browsing, placing orders, or for informational purposes, provided that you retain all copyright and proprietary notices. You may not reproduce, disseminate, modify, sell, republish, or in any way exploit any Content from the Mactukd Services without prior written permission.

Commercial use or use of the Content from the Mactukd Services that infringes upon the legal rights of others is strictly prohibited.

Mactukd reserves the right to modify, remove, or update the Content at any time without prior notice, including omissions, typos, or outdated content. Unless expressly stated otherwise, the Content does not constitute a legally binding commitment or warranty.

Submissions; Intellectual Property Infringement Claims

Except as otherwise expressly provided in this Statement or in Mactukd's separately posted Privacy Policy, any communications or materials you submit to Mactukd through the Mactukd Services, whether by electronic mail or otherwise (including, but not limited to, contest or sweepstakes entries, images, photographs, video files, audio files, articles, questions, comments, suggestions, feature ideas, modification suggestions, product or technology enhancements, content, promotional ideas, product naming schemes, and documentation, artwork, computer code, graphics, or other materials related thereto, (collectively, "Submissions")) will be treated as non-confidential and non-proprietary.

You hereby grant Mactukd, its suppliers, and its affiliates or related entities a worldwide, perpetual, irrevocable, transferable, fully paid-up, royalty-free, non-exclusive license to use your Submissions for any purpose, including, but not limited to, reproduction, storage, modification, transmission, publication, display, broadcast, publicity, or promotional and marketing in any media channels, without further notice, permission, compensation, or other consideration, unless otherwise prohibited by law.

Mactukd has no obligation to review, consider, or adopt any Submission, and assumes no liability for not accepting or returning any Submission, in whole or in part.

For all Submissions, you represent and warrant that:

(a) you have the full rights to license the Submission to Mactukd;

(b) the Submission does not infringe the intellectual property, privacy, publicity, or other legal rights of any third party;

(c) the Submission is true and accurate; and

(d) Mactukd's use will not violate these Terms and will not cause injury to any person or entity.

You further grant Mactukd and its sublicensees the right to use your name, username, avatar, image, or message in connection with the Submission. Mactukd reserves the right, but not the obligation, to monitor, edit, or delete any Submission and assumes no responsibility for content posted by you or any third party.

Mactukd reserves the right to refuse to accept or distribute user Submissions for any reason and may remove Submissions from its platform for any reason.

Third-Party Websites and Content

The Mactukd website may contain links to third-party websites, including those operated by Mactukd's suppliers. The presence of these links does not imply an endorsement, guarantee, or recommendation by Mactukd of their content, policies, or practices. These websites are independently operated by third parties, and Mactukd is not responsible for their content, availability, security, privacy policies, or other practices.

To the extent certain content is provided by third parties, Mactukd provides it for informational purposes only. 

Disclaimer and Limitation of Liability

Your use of Mactukd services is at your own risk. To the extent permitted by law, Mactukd and its affiliates disclaim all warranties, express or implied, regarding the services, products, linked websites, and content, including, but not limited to, warranties of accuracy, completeness, merchantability, fitness for a particular purpose, non-infringement, security, or lack of viruses. Mactukd does not guarantee that the service will be uninterrupted or error-free, or that defects will be corrected.

All content provided through the Mactukd service is provided on an "as is" and "as available" basis, and Mactukd assumes no liability of any kind.

To the maximum extent permitted by law, Mactukd and its affiliates are not liable for any direct, indirect, incidental, special, consequential, or punitive damages, including lost profits, business interruption, or lost data, arising out of your access to or use of the service and content.

You understand and agree that any material downloaded or otherwise obtained through the Mactukd service is at your own risk.

Any advice or information provided by Mactukd does not create an express warranty.

Mactukd's aggregate liability to you under these terms shall not exceed the price paid by you for the product or service at issue, but does not limit liability for personal injury or property damage.

Any dispute must be notified to Mactukd in writing within one year after it arises; failure to do so will be deemed waived.

Indemnification

You agree to defend, indemnify, and hold harmless Mactukd and its affiliates, directors, and employees from and against any claims, losses, liabilities, and expenses (including attorneys' fees) arising out of or related to your breach of these Terms or your use of the Mactukd Services. This obligation shall survive termination of these Terms.

Electronic Communications

By using the Mactukd Services, you consent to receive electronic communications. Mactukd may provide notices by email or through the Services, and such electronic communications satisfy any written notice requirements.

Governing Law and Jurisdiction

These Terms and any disputes arising therefrom shall be governed by English law, without regard to conflict of law principles. You consent to and waive any objection to the exclusive jurisdiction of the English courts to resolve any dispute.

Miscellaneous

These Terms constitute the entire agreement between the parties and supersede all prior written or oral agreements. The invalidity of any provision shall not affect the validity of any remaining provisions.

Mactukd reserves the right to assign its rights and obligations under these Terms.

Mactukd shall not be liable for any delay or failure in performance due to causes beyond its reasonable control, including, but not limited to, acts of third parties, war, natural disasters, legal restrictions, etc.
